In light of the ongoing humanitarian crisis unfolding before the eye of Humanity, I, a lawyer acting as a surrogate for the Palestinian people, have taken upon myself to fill this complaint to the International Criminal Court, his Excellency Mr Karim A. A. Khan KC.
The request, of 40 pages, calls for the immediate start of an investigation into the crimes committed against the Palestinian people since October 7, 2023, and the expedite issuance of arrest warrants against
Mr. Benjamin Netanyahu, as Prime Minister of Israel,
Mr. Yoav Galant, as Minister of Defence of Israel,
Mr. Isaac Herzog, as President of Israel
for their roles as leaders of the State of Israel and their implication in the ongoing crimes perpetuated on the Palestinian territory.
The crimes and their severity demands an urgent investigations and broad charges against the defendants seeing the scale of the suffering inflicted on innocent civilian lives.
The present request highlights how the defendants, through their respective roles, have actively breached numerous international provisions, and continue to do so, with impunity in the silence of the international community.
The defendants, for their involvement in the acts perpetuated in Gaza, hereby stand in violation of:
- The Geneva Convention relative to the Protection of Civilian Persons in Time of War, 1949, in its most sacred provisions as the defendants have actively taken actions violating the rights of Palestinian people as encompassed in articles 3, 16, 17, 18, 20, 21, 23, 24, 27, 31, 33, 34, 42, 43, 49, 50, 53, 56 and 78 of the Convention of
- The Rome Statute, 1998, and more specifically its articles 6 on Genocide, its article 7 on Crime Against Humanity, its article 8 on War Crimes, and its article 8bis on the Crime of Aggression.
Through their leadership, the defendants have inflicted what reads as a collective punishment on the Palestinian population. They have shamelessly been using disproportionate force while intentionally targeting civilians – submitting them to inhumane treatments and arbitrary killings -, medical facilities, – under false justifications – , and cultural inheritance sites.
The actions carried out in Gaza since October 7, 2023 have been documented and recorded by NGOs, media and acknowledged by several governments. Yet, the defendants, at the head of their troops, continue to unleash death and devastation without hindrance. With more than 100,000 victims to date, it is time for the international community, and especially the International Criminal Court, to step up and hold the culprits accountable for their actions.
The atrocities perpetrated, and ongoing, in Gaza are a shadow slowly tainting the entirety of humanity and it is time for the Court to act as the beacon she has been untrusted to be and held accountable the men responsible for these crimes.
